Deadline: 3rd March 2023

Capacity Law Code of Practice

The Committee for Health & Social Care (HSC) is consulting on the draft Code of Practice for the Capacity (Bailiwick of Guernsey) Law, 2020.

The Code underpins the Law by setting out the practical details and processes which should be followed when performing duties and exercising powers under the Law. This is a key part of the work currently being undertaken by the Committee to implement the Law in its entirety, having already brought into force the provisions relating to Lasting Powers of Attorney.

The Code also aims to empower people to make decisions about their lives wherever possible and to protect their human rights, while affording them the greatest care and respect. It  ensures that the Law is implemented across the Bailiwick in a consistent and practical manner, and it seeks to reflect current best practice and give clear and accessible guidance for those that need it.
